Wow, the Clint Eastwood Superbowl Commercial: www.chrysler.com/SuperBowl Ad (is probably one of the most powerful that I have ever seen. Chrysler has capitalized on Clint Eastwoods image and reputation, who may be a little older but is still looked upon as a Hero from several generations and the message is incredible. It’s also great that Chrysler has made the point the the Motor City and Detroit are coming back and really did not speak much of Chrysler until the very end of the Super Bowl Commercial from Chrysler and the Endorsement of the Chrysler Super Bowl Commercial for Chrysler and Detroit.

Chevrolet’s Superbowl commercial is probably going to result in litigation with Ford which may give both of them some additional benefit, however the Chevrolet Superbowl Commercial was very weak and really did not say too much except picking on Ford Truck’s, which Ford has already had a great response as to why they did not respond to Chevrolet’s Super Bowl Commercial Claim’s. I am not sure if Chevrolet’s Advertising Agency is still Campbell Ewald but if they were at the heart of this disaster, I am sure they will deffinately regret this bashing of the competition for years to come as that goes back to marketing 101 – “Don’t Bash Y0ur Competition” especially if they can rebut your claim’s! It make’s you look like your grasping as straw’s and doing whatever it takes to gain market share. I really think that “Super Bowl Chevy Commercial” is going to back fire on General Motors.

It may be unbelieveable to some people that Ford did not buy any Super Bowl Advertising, however the Marketing Department may have decided that the cost was not worth the benefit as Ford seems to be doing a great job and is gaining market share and setting sales records even in a difficult economy? The Marketing Director at Ford, did admit after the fact, that he may have made a bad decision by not participating in the Auto Manufacturers Super Bowl Advertising.

Chrysler’s Super Bowl Commercial featuring Clint Eastwood as spokes person for both Chrysler, the Motor City, and Detroit, was an incredible work of art in the Marketing and Advertising world! This Chrysler Commercial will be the “Talk of the Industry” for many years to come especially taking advantage of such a recognized spokesperson as Clint Eastwood’s Super Bowl Commercial, who has already made a Mark as a “Hero” in over three generation’s and will go down in the Marketing and Advertising History of Super Bowl Commercial’s.

Glad Madonna is off the stage as the Half Time Super Bowl performer, I think Madonna is one of the least talented Half Time Super Bowl Performers, to ever make it big, wonder if she was lip sinking again. The only good thing I can say is she has a great staff of Costume Designer’s, Correographers, etc., to pull this off, but since Madonna agreed to pay for the performance, it’s understandable why they had Madonna perform over Elton John or the other candidates at the Half time Super Bowl Celebration. At least there were no costume malfunction’s for any one to see her wore out parts.

Honda Small Claims Litigation could cost Honda over 2 Billion

National Auto Liquidators is considering assisting current owners of Honda Civic Hybrid’s in disposing of these vehicles pending the results of the pending “Class Action” and “Small Claims” litigation outcome.

Heather Peters of Los Angeles, California, filed a small claims law suit against Honda as she believes that the gas mileage that she experienced was less than the 50 Miles per gallon as promised by the Sales literature and Staff when she purchased the Hybrid.

Honda is currently pending a “Class Action” regarding this claim with around 200,000 Plaintiff’s according to Peter’s.

A Judge in San Diego is expected to Rule on the Class Action settlement offered by Honda for these Hybrid owners in March but the members of the “Class” have until February 11th to accept or reject the offer. Honda is offering a proposed settlement of up to $200 cash and a rebate between $500 and $1000 towards the purchase of another Honda.

Superior Court Commissioner, Douglas Carnahan is expected to rule on the Small Claims litigation as filed by Peters, (a former Attorney) this week.

If Peters is succefull in obtaining a Judgment for $10,000, it will definately have an impact on the decisions of the Class to accept two hundred dollars cash and a Rebate up to $1000, as well as the Judge’s discretion in determining the “Class Action” terms of settlement.

This “Small Claims” Action could be a huge set back for Honda just in legal fee’s alone if other member’s of the class decide to follow in Peter’s shoe’s and file in small claims rather than accepting the Class Action Settlement.

Honda has a large legal department. However, if only ten percent of the potential “Class Action Members” decide to reject the offer and proceed to Small Claims Action’s on thier own, that is about 20K new Small Claim cases that could be filed in the next few months or if spread out over an entire year, approximately four hundred cases per week. Each and every small claim has to be answered usually within 21 days of receipt of Notice, (Depending on the County and State of initial filing). Generally speaking, most of these type’s of claims are filed in Federal or Circuit Court and are fewer and far between as they require an Attorney and a lot of preperation and sometimes several years to resolve. Small Claim’s are generally resolved very easily and within 45 day’s and are not usually subject to appeal.

The fact that several Attorney General’s from various State’s are involved in the Class Action seems to make it an easy resoloution for Peter’s success as well as other possible small claim litigants.

Most District Court’s only charge a minimal filing and processing fee for any Small Claim Litigation which is usually less than one hundred dollars. The filing itself is very simple and only requires a Notice of Claim and or Notice to Appear which is sent by registered Mail. Once the case is presented, it is up to the person who files the Claim to state their Case and than up to the Defendant (Honda) to dispute the Claim, and than up to the Judge to rule on the evidence as presented. The Judge has much more discretion and the rules for evidince are much more relaxed, in these types of Claim’s as their are much fewer rules than the higher Court’s.

This litigation could be very detrimental to Honda and any other HyBrid manufacturers who misrepresent gas mileage claims especially with the recent Attorney General Action’s regarding truth in advertising, Consumer Right’s, and the Federal Trade Commission’s consumer Protection Act.

If Honda does not have the Human Resources in the various Legal Department’s to answer all of the complaints, and/or fails to appear, than the Plaintiff receives a Default Judgment for all of the damages requested.

If Peters is successful, certainly even the Lay Man will be able to duplicate her claims and probably win in any Small Claim’s Litigation especially if the Defense (Honda) is not able to show up to defend the Litigation if they are overwhelmed.

In many States, a Lawyer is not allowed to defend a Client in “Small Claims Litigation” and many other’s do not allow a representative of the Company to Practice Law without a License if representing a Corporation.

One thing for sure, Ford, GM, Chrysler, Toyota, and all of the major hybrid manufacturers are watching this case in order to avoid further conflict’s.

Most likely, there are a lot of Judge’s, (former Lawyer’s), and lawyer’s who are watching the outcome of this litigation. After all, they spend year’s and substaintial financial comittments in achieving law degree’s and are adverse to the Common Lay Man substantiating the right of the common person to win a judgment against a Giant Corporation as big as Honda as that is how they make their living. Fortunately, their are many “Fair Small Claim’s” judges that only have to rule on the Fact’s as presented in their Court and really do believe in the Law!
